Maltech-Africa Veritas: Terms of Use

These Terms of Use govern your use of africasmeveritas.org ("the Website") and the information, tools and services offered through it ("the Services"). By using the Website you agree to these terms. If you do not agree, please do not use it. Additional written agreements or service terms may apply to particular Services and, where they conflict with these terms, will prevail for that Service.
Who we are (supplier information):

2.1 The Veritas Services, including verification, valuation, Data Pool registration and funding facilitation, are available only to formally registered businesses.
2.2 Businesses that are not yet formally registered may use the Website's general information and our Formalization guidance, but may not register in the Data Pool or access funding facilitation until they have completed registration and compliance.
2.3 You confirm that you have authority to act for any business you register or submit information about.
2.4 We may, in our discretion, decline, suspend or end access to any Service where eligibility is not met or cannot be verified.
The Services may include Formalization guidance, business verification and reports, valuation tools and reports, registration in the Veritas Data Pool, Credit Readiness Profiles, funding facilitation, and publications and insights. The Website describes each Service in general terms. Specific scope, fees and timelines are set out in your quote, order or agreement.
4.1 Verification. Verification reports reflect information available to us and the checks performed at the date of the report. They are not a guarantee of a business's future conduct, solvency or compliance.
4.2 Valuation. Unless we state otherwise in writing, valuations and outputs from the SME Valuation Calculator are indicative only. They are not certified, audited or independent valuations and should not be relied on for legal, tax, transaction or regulatory purposes without professional advice.
4.3 Credit Readiness Profile. A Credit Readiness Profile is a summary of verified business information. It is not a credit rating, credit score or credit report, and Veritas is not a credit rating agency. Lenders make their own decisions.
4.4 Funding facilitation. We facilitate introductions and applications. We do not lend money and we do not guarantee that any funding will be offered, approved or paid. All funding is subject to the lender's or investor's own approval, criteria and terms.
4.5 No professional advice. Content on the Website and in our publications is general information. It is not legal, tax, accounting, investment or financial advice. Please take advice from a qualified professional about your own circumstances.
You agree that:
• all information and documents you give us are accurate, complete, current and lawfully obtained
• you will tell us promptly if anything changes
• you will not submit false, forged or misleading information
• you will keep your login details confidential and are responsible for activity under your account
• you will comply with all applicable laws, including those relating to business registration, tax, immigration, anti-money-laundering and data protection
You may not:
• use the Website for any unlawful, fraudulent or deceptive purpose
• impersonate another person or business, or misrepresent your affiliation or eligibility
• attempt to gain unauthorised access to the Website, other users' accounts or our systems
• introduce malware or interfere with the operation of the Website
• copy, scrape or systematically extract data from the Website or Data Pool without our written permission
• use our reports, Data Pool insights or Services to mislead any third party
7.1 Fees are as quoted or shown for each Service, in South African rand unless stated otherwise.
7.2 Consultation and assessment fees are non-refundable. Where a consultation or assessment fee has been paid and you proceed with a further service, that fee is credited towards the next phase where our quote says so.
7.3 Once we have begun work or made a submission or report on your behalf, fees paid are not refundable, unless the law requires otherwise. Errors on our side will be corrected at no cost to you.
7.4 Third-party fees, such as government or department fees, verification-provider fees and travel costs, are for your account unless we quote otherwise.
The Website, its content, tools, reports, calculators, designs, trademarks and logos belong to us or our licensors and are protected by law. You may view and download content for your own business use. You may not reproduce, resell, distribute or create derivative works from it without our written permission. The names Maltech Africa and Veritas may not be used without our consent.
We handle personal information as set out in our Privacy Policy. You agree to keep confidential any non-public reports or information we give you and to use them only for the purpose for which they were provided.
The Website may link to third-party sites, and funding facilitation involves lenders and investors that we do not control. We are not responsible for their content, terms or conduct. Your dealings with them are governed by their own terms.
The Website and Services are provided on an "as is" and "as available" basis. To the extent permitted by law, we do not warrant that the Website will be uninterrupted or error-free, or that information on it is always complete or current.
12.1 To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, business or opportunity, arising from your use of, or reliance on, the Website or Services, including a funding decision made by a third party.
12.2 Where we are found liable to you, our total liability for any claim is limited to the fees you paid us for the specific Service that gave rise to the claim.
12.3 Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including under the Consumer Protection Act 68 of 2008 where it applies, or liability for fraud or gross negligence.
You indemnify us against claims, losses and costs arising from information you provide that is false or unlawful, or from your breach of these terms, to the extent permitted by law.
We may suspend or end your access, or remove your business from the Data Pool, if you breach these terms, provide false or misleading information, fail to meet eligibility requirements, or if we are required to by law. You may stop using the Services at any time and may ask us to remove your business from the Data Pool.
We may amend these terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Website after that date means you accept the updated terms.
16.1 These terms are governed by the laws of the Republic of South Africa.
16.2 You agree to the jurisdiction of the South African courts, and the High Court of South Africa, Gauteng Division, Pretoria, has jurisdiction over disputes.
16.3 If any part of these terms is invalid, the rest remains in force.
16.4 Our failure to enforce a right is not a waiver of it.
16.5 These terms, together with our Privacy Policy and any written service agreement, are the whole agreement between us about the Website.
